R. 1624 IN THE HOUSE OF REPRESENTATIVES February 26, 2025 Mr. Moolenaar (for himself, Mr. Bergman , Mr. Bentz , Mr. Crawford , Mr. Webster of Florida , Mr. Huizenga , Mr. Meuser , Ms. Scholten , Mr. Lucas , Mr. Newhouse , Mr. LaHood , and Mr. Fulcher ) introduced the following bill; which was referred to the Committee on the Judiciary A BILLTo direct the Secretary of Labor to modify the implementation of the adverse effect wage rate for H–2A nonimmigrants.1.Short titleThis Act may be cited as the Supporting Farm Operations Act of 2025 .2.Modified implementation of adverse effect wage rate for H–2A nonimmigrantsThe Secretary of Labor shall ensure that the adverse effect wage rate required to be paid under section 655.1308 of title 20, Code of Federal Regulations, to nonimmigrants admitted under section 101(a)(15)(H)(ii)(a) of the Immigration and Nationality Act ( 8 U.S.C. 1101(a)(15)(H)(ii)(a) ), that was in effect in a State on December 31, 2023, remains the adverse effect wage rate for such employees in that State through December 31, 2026.3.Clarification of job classificationFor the purposes of determining the wage required to be paid referred to in section 2, the Secretary of Labor shall utilize a primary duties evaluation for such employees who may be performing more than one duty or task.
