7 Statement of purpose of bill as introduced: This bill proposes to repeal the
8 Affordable Heat Act.
9    An act relating to repealing the Affordable Heat Act
10 It is hereby enacted by the General Assembly of the State of Vermont:
11 Sec. 1. REPEAL
12    30 V.S.A. chapter 94 is repealed.
13 Sec. 2. 32 V.S.A. § 3102 is amended to read:
14 § 3102. CONFIDENTIALITY OF TAX RECORDS

16    (e) The Commissioner may, in the Commissioner’s discretion and subject
17 to such conditions and requirements as the Commissioner may provide,
18 including any confidentiality requirements of the Internal Revenue Service,
19 disclose a return or return information:

1(23) To the Public Utility Commission and the Department of Public
2 Service, provided the disclosure relates to the fuel tax under 33 V.S.A. chapter
3 25 and is used for the purposes of auditing compliance with the Clean Heat
4 Standard under 30 V.S.A. chapter 94. The Commissioner shall, at a minimum,
5 provide the names of any new businesses selling heating fuel in any given year
6 and the names of any businesses that are no longer selling heating fuel.

9 Sec. 3. ABOLISHMENT OF CLEAN HEAT STANDARD POSITIONS
10    For fiscal year 2025, as of January 1, 2026, the positions created in 2023
11 Acts and Resolves No. 18, Sec. 7(a) (Public Utility Commission) and (c)
12 (Department of Public Service) that support the Clean Heat Standard program
13 are eliminated.
14 Sec. 4. EFFECTIVE DATE
15    This act shall take effect on passage.
