Tennessee Code Annotated, Title 4, Chapter 11, Part 1, is amended by addingthe following as a new section:Notwithstanding another law to the contrary, the Tennessee historical commission, andany other state entity other than the state building commission engaged in the historicpreservation of real property, shall not regulate the renovation, alteration, or demolition ofimproved public or private real property that is not listed on the Tennessee register of historicplaces, or take any adverse action against the owner of such real property, if the real property:(1) Has been eligible for, offered placement on, or considered for placement onthe Tennessee register of historic places, but the commission declined placement onthe register and the property was not added to the register; or(2) Has not been provided with any protection, grant, or other benefitsassociated with eligibility for the Tennessee register of historic places.SECTION 2. The Tennessee historical commission shall complete its review of any and allrelevant information relating to a community development block grant proposed to be issued to aproperty meeting the description under Section 1 no later than fifteen ( 15) business days after theeffective date of this act. If the commission fails to complete its review as required under this Section2, the joint government operations committee of the house of representatives and the senate shallrequire the commission to appear before the committee to justify its noncompliance with this Section2.SECTION 3. As enacted, prohibits the commission, and any other state entity other than the state building commission engaged in the historic preservation of real property, from regulating the renovation, alteration, or demolition of improved public or private real property that is not listed on the Tennessee register of historic places, or taking any adverse action against the owner of such real property, if the real property meets certain criteria. - Amends TCA Title 4; Title 7; Title 8; Title 13 and Title 66.
