To amend title 5, United States Code, to provide that judicial review under the Administrative Procedure Act does not include any evidence that the court determines is not the product of reliable scientific principles and methods.
1. Evidence derived from reliable scientific principles and methods
Section 706(2) of title 5, United States Code, is amended—
(1) in subparagraph (E) by striking “or” at the end;
(2) in subparagraph (F) by striking the period at the end and inserting “; or”; and
(3) by adding at the end the following:
(G) supported by evidence that the court determines is not the product of reliable scientific principles and methods, or that does not reflect a reliable application of those principles and methods.
